Harsher sanctions won’t reduce assaults on police and NHS workers. Most assaults are in the moment. The sanctions need to leave the officers feeling supported after the event. (policeofficer)

A new offence for assaulting an emergency worker was created in 2018. Since then the maximum penalty for assaulting an emergency worker has doubled twice, from six months to two years’ imprisonment. Has this change achieved its aim – that is, has it reduced violence and abuse towards emergency workers?

Not according to new research by Transform Justice. Many assaults against emergency workers aren’t pre-meditated. They happen in the moment rather than by people who have weighed up the pros and cons beforehand, so increasing sanctions won’t work to deter this behaviour. The Ministry of Justice itself, in its impact assessment of the changes in sentencing for this offence, said the evidence that the changes would deter people was “weak and mixed”.  

We also found evidence of the new sanctions having an undesirable side effect – sweeping more people with mental health conditions, cognitive impairments and/or who are neurodivergent into the criminal justice system. This is partly because police and NHS workers are not always well trained to identify and communicate with people with mental health conditions, meaning interactions can be more likely to escalate, ending with the person prosecuted for assault. Police and the courts don’t always have the information or confidence to factor mental health conditions into the decision to charge and prosecute.

So if prosecution and harsh sanctions aren’t effective in reducing abuse, and are actually having detrimental consequences for people with mental health conditions or who are neurodivergent, how can we protect police and NHS workers in the workplace?

Employers can improve how they support victims and deal with assaults through consistent, compassionate de-briefings followed up by action to resolve the harm and reduce the risk of it happening again. Ways to resolve assaults without going to court, such as through diversion to courses or services, or restorative justice, can be much better utilised. And we need much more focus on how assaults arise in the first place, to learn how to address the issue at the source through better training and staffing.

It was brilliant to have the opportunity to discuss the issue of assaults on police and NHS workers on #wecops recently. The new Transform Justice report questions whether increased criminal sanctions are working to reduce assaults and highlighted some of the unintended consequences for people with mental health conditions, cognitive impairments and/or who are neurodivergent. We were keen to hear people’s thoughts on some of the findings.

Over the course of the hour we discussed three questions:

  1. How do assaults on emergency workers arise in the first place? Is it pre-meditated or in the moment?
  2. What do you think would help emergency workers who have been assaulted to recover, find resolution and move on?
  3. How can we prevent incidents of violence towards emergency workers in the first place?

The discussions were wide-ranging and I can’t do justice to them in 500 words so I’ll pick up on a few points that stood out to me. The chat focussed mainly on assaults on police.

We asked how assaults on emergency workers arise in the first place – are they pre-meditated or are most in the moment? Commenters said lots of assaults aren’t pre-planned: that they usually occur “in the moment”, although some could recall rare examples of planned attacks. Many linked assaults to alcohol or drug misuse issues. We estimate the majority people prosecuted for assaulting emergency workers have a mental health condition, cognitive impairment and/or are neurodivergent. There were over 22,000 prosecutions for assaults on emergency workers or police in 2021. We argue in our report that if most aren’t premeditated, are court sanctions an effective response?

One theme that struck me from the comments was a view that people’s respect in police is declining, and a rise in assaults is an indicator of this. People talked about assaults being symptomatic of “a gradual breakdown in respect, discipline & general order”, of kids growing up with “with no respect for authority”, and that “there’s an increasing section of society more willing to resist arrest”. There are indications that public trust and confidence in the police is waning after high profile news stories about the Met police and others. I’m not sure increased assaults are a side effect of this, but if they are, more punitive responses from the police is unlikely to be the solution. Police legitimacy must be rebuilt in other ways. As one sergeant said: “A bit out there but increasing legitimacy and trust [would prevent assaults]. If you increase these things greater compliance by the public as a whole.”

What would help emergency workers who have been assaulted to recover, find resolution and move on? One thing we heard was support that is tailored to what the victim needs. This could comprise an effective debriefing, time to recover (if needed) before getting back on the job, and access to restorative justice so that the victim can talk about the impact and so the person who committed the assault recognises harm done. Some did feel harsher sentences were the answer, and a more consistent application of these.

We had a real range of responses to the question of how to prevent incidents of violence and abuse against emergency workers happening in the first place. One suggestion that cropped up several times was to reduce “single crewing”, i.e. officers going out to incidents alone. I’d heard of a potential link between assaults and single crewing during our research. Presumably the thinking is that if an officer is on their own, someone may feel more confident to “try it on” and resist arrest, which can end in violence. Or perhaps having two officers means any restraint and arrest can be conducted more quickly, reducing the opportunity for violence to occur. Given how often this suggestion was made it was good to have a Lincolnshire ACC come in citing research into assaults in her force. This found that actually most assaults happened when officers were working double crewed or in custody. So as she said, “double crewing is not the answer.” Others had some different ideas including better training in de-escalation, more staff, and harsher sentences (I’m afraid we don’t agree with harsher sentences as a solution – evidence shows they don't work as a deterrent!).

Mostly fuelled by alcohol &/or drugs. But we do seem to have more & more angry people about. Juveniles & female offenders on the up #WeCops

@PenelopeGibbs2 @WeCops @fionnualarat @TransformJust1 #wecops Sometimes When I've been involved in s136 detention, I have been assaulted including use of martial arts weapons *but* I haven't looked on it as assault police. It's just a risk of using s136 powers. Sometimes though it's just resisting arrest. Drink / drugs play a part.

Officers writing their own statements etc still happens. It’s a Line Manager Lottery when it comes to this support and that’s wrong on all levels. #wecops

Moving on is arguable depending on injuries, recup etc. Some will never move on but majority want justice - some now consider it part of the risk of the job.

They need to self reflect if they could have handled some situations differently. Comms skills are key. Doesn't excuse assaults but it can be a contributory factor. #WeCops

I know some colleagues have had MH 1st Aid training but I’ve not had that. The dream answer would be MH services being properly equipped & funded so Police don’t have to deal. ???? #WeCops

We don’t in my force send unless unavoidable single crewed officers to conflict situations alone. #WeCops

Cast aside notions that we are policing like PC George Dixon in an episode of Dixon of Dock Green. Put hard operational realities over corporate image. Q3 The way that the police are perceived in media and the public mind is also very likely to have an impact on assaults. If we are unsupported / perceived to be unsupported by Govt, media, society in general then it emboldens / gives excuse to assaulting EMS workers #WeCops

We can learn from lessons in the military that less experience = more negative incidents / outcomes. Training absolutely crucial. #WeCops

That said if I'm pushed in to using force to end a confrontation I will. Some people just want a fight with the uniform ????? #WeCops

We were shown about 8 different ground techniques in about an hour on recent ost, instructor said find the one you like, then commit to muscle memory. He clearly didn't understand it. Regular fitness time as well, #wecops

Has social media played a role in promoting violence and/or also does a fear of scrutiny mean officers subconsciously wait to be assaulted before justifying force ?? #WeCops
